This notice explains the role of HKStableLife and the arrangements between users and merchants. It does not affect rights you have under Hong Kong law.
Role of the platform
HKStableLife (the “platform”) provides search, pages, and contact channels so that users may read material published by merchants and contact those merchants themselves. Except where the platform expressly contracts in its own name, the platform is not the supplier of the goods or services, and is not a party to any sale, booking, service, agency, or employment arrangement between a user and a merchant.
Payments
The platform does not at present collect, hold, or transfer money for users or merchants. The free plan has no collection function. If a paid plan later offers PayMe for Business or AlipayHK merchant collection, or a status marking payment inside the system, any such payment is made into the merchant’s own collection account under the rules of the relevant payment service. A payment status in the system is a record only. It is not confirmation that the platform has received the money, and it is not confirmation that the merchant has performed the contract.
Merchant information
Names, descriptions, and contact details on a page are supplied by the person who publishes them. The platform does not warrant the identity, licence, qualification, or ability to perform of any particular merchant. Before paying or agreeing to take a service, a user should check that the other party’s identity, business status, and collection account correspond. If a user suspects that someone is impersonating a merchant in order to collect money, the user should stop paying and may report the matter to the Hong Kong Police and the relevant payment institution, and may also notify the platform through the contact channel on this website. After the platform becomes aware of such a report, it will take reasonable steps in the circumstances, which may include restricting or removing the page.
Liability
To the extent permitted by the Control of Exemption Clauses Ordinance (Cap. 71), the Supply of Services (Implied Terms) Ordinance (Cap. 457), and any other applicable law, the platform is not liable to a user for whether a contract between the user and a merchant is formed, whether the merchant performs, the quality of the merchant’s goods or services, or loss caused by the merchant’s breach. Nothing in this notice excludes or limits liability for death or personal injury caused by negligence, liability for fraud or fraudulent misrepresentation, or any liability which the law does not allow to be excluded or limited, including, where a person deals as a consumer, liability for failing to carry out a service with reasonable care and skill.
Consumer rights
Use of the platform does not reduce rights a user has under Hong Kong law. A dispute about a merchant’s goods or services should first be taken up with that merchant. A matter about the operation of the platform itself may be raised with the platform through the contact channel on this website. A user may also enquire or complain to the Consumer Council. This notice is governed by, and is to be read in accordance with, the laws of the Hong Kong Special Administrative Region.
